Following the verifications carried out within the Electronic Public Procurement System (SEAP), aspects related to the compliance with the equivalence requirements, in the sense of misapplication of art. 156 of Law no. 98/2016 on public procurement, respectively art. 166 of Law no. 99/2016 on sectoral procurement were identified. These aspects may generate financial corrections at the level of projects implemented within Interreg V-A Romania - Bulgaria.

Consequently, in a matter of urgency, we are kindly asking you to perform an analysis of the ongoing procurement procedures, and, in case errors referring to the national or European standards are identified, to correct them, including by publishing a corrigendum in due time and in compliance with the conditions provided by the legislation in force.
We remind you that, if technical specifications related to national standards which transpose European standards, European technical assessments, common technical specifications, international standards, other technical reference systems established by the European standardization bodies or, in the absence of any of these, national standards, national technical agreements or national technical specifications related to the design, calculation and execution of works and the use of products, etc., are mentioned within the procurement documents, they must be accompanied by the statement “or equivalent”.
